TERMS AND CONDITIONS OF SALE

By using the Agrico Plastiques Ltd. website or placing an order, the customer agrees without reservation to these terms and conditions of sale.

RETURN FEES

All returns are subject to a 15% restocking fee. Return shipping costs are the responsibility of the customer. No exchange or refund will be accepted for:

• cut hoses
• custom-made products
• items identified as special orders
• products modified from their original condition
• products that have been used or altered and are no longer in resalable condition

Returned products must be in new, resalable condition and in their original packaging.

PRICING, PRODUCTS AND ACCURACY OF INFORMATION

Prices, descriptions, dimensions, technical specifications, images and product availability are subject to change at any time without notice. Agrico Plastiques Ltd. reserves the right to correct any error, inaccuracy or omission, including after an order has been submitted, and may cancel or refuse any order based on incorrect information. Images are for illustrative purposes only and may differ from the actual product. All prices are in Canadian dollars and are exclusive of applicable taxes, unless otherwise stated.

ORDER ACCEPTANCE AND CANCELLATION

Receipt of an order does not constitute automatic acceptance.

Agrico Plastiques Ltd. reserves the right to refuse, limit or cancel any order, including in cases of:

• pricing or description errors
• payment issues
• insufficient availability
• or any other reasonable cause

Special, custom or made-to-order products cannot be cancelled once confirmed or put into production.

PAYMENT TERMS

All payments must be made in Canadian dollars.

Online purchases by credit card:
Online purchases may be paid directly on our website using Visa or MasterCard. If the total transaction amount exceeds the authorized limit, the customer must contact the sales department to receive an invoice, which may be paid by bank transfer.

Account purchases:
If a customer account has been approved, purchases may be charged to the account within the assigned credit limit. Any excess must be paid immediately according to the proposed payment methods.

In the event of non-payment, Agrico Plastiques Ltd. reserves the right to:

• suspend shipments
• cancel pending orders
• modify or revoke credit terms without notice

AVAILABILITY AND DELIVERY TIMES

Products are subject to availability.

Delivery times are provided for information purposes only and may vary depending on:

• suppliers
• production
• transportation conditions

Agrico Plastiques Ltd. shall not be held responsible for delivery delays. No delay shall justify cancellation, penalties or claims.

SHIPPING AND TRANSFER OF RISK

Products may be shipped from:

• Agrico Plastiques Ltd.’s warehouse
• or directly from the manufacturer

Risk transfers to the customer:

• upon pickup by the customer
• upon delivery to the customer or their representative
• or upon handover to the carrier when arranged by the customer

The customer is responsible for inspecting the goods upon receipt.

Any visible damage, error or discrepancy must be reported immediately to the carrier and to Agrico Plastiques Ltd. within 24 hours of receipt. No transportation-related claims will be accepted after this period, except in the case of a proven hidden defect.

RETURN POLICY

Any return request must be made within 21 days of receipt of the goods. A return authorization number must be obtained prior to any return. Products must be returned within 7 days following issuance of the authorization, prepaid, to the designated warehouse. Agrico Plastiques Ltd. reserves the right to refuse any unauthorized return or any product that does not meet the established conditions. For more details, refer to the “Shipping and Returns” section of the website.

CUSTOMER RESPONSIBILITY AND PRODUCT USE

The customer is fully responsible for:

• selecting the appropriate products
• ensuring compatibility with their intended application
• chemical compatibility
• installation
• integration with existing equipment
• proper use in accordance with recommendations

Agrico Plastiques Ltd. shall not be held responsible for improper or non-compliant use.

CUSTOM AND MADE-TO-ORDER PRODUCTS

For any product manufactured according to customer specifications, the customer is responsible for the accuracy of the information provided. Agrico Plastiques Ltd. shall not be responsible for errors, incompatibilities or consequences resulting from customer-provided specifications.

LIMITED WARRANTY

Agrico Plastiques Ltd. warrants that its products are free from defects in material and workmanship for a period of one (1) year from the date of purchase, provided they are used under normal and intended conditions.

This warranty does not cover:

• improper installation
• misuse
• overloading
• mechanical stress, vibration or excessive strain
• chemical incompatibility
• use outside recommended temperature ranges
• lack of proper support for connected equipment
• normal wear, abrasion, UV exposure or aging

For plastic tanks modified with welded fittings or flanges:

The weld is warranted for a period of one (1) year, provided that all connected equipment, accessories, piping or loads are properly supported to eliminate any stress on the welds. Any load, strain or movement applied directly to a weld voids the warranty.

If a product is deemed defective, Agrico Plastiques Ltd. may, at its discretion:

• repair it
• replace it
• or issue a credit equal to the original purchase price

LIMITATION OF LIABILITY

Agrico Plastiques Ltd.’s total liability is strictly limited to the purchase price of the product concerned.

Under no circumstances shall Agrico Plastiques Ltd. be liable for:

• loss of production
• loss of revenue
• contamination
• damage to other equipment
• operational downtime
• or any indirect or consequential damages

FORCE MAJEURE

Agrico Plastiques Ltd. shall not be held responsible for any delay or failure to perform resulting from circumstances beyond its control, including but not limited to: strikes, shortages, transportation disruptions, fire, natural disasters, supplier failure or any other unforeseen event.

EXPORT

Products sold are intended for use within Canada. 
The buyer is fully responsible for any export activities, including:

• regulatory compliance
• documentation
• importation into the destination country

MODIFICATION OF TERMS

Agrico Plastiques Ltd. reserves the right to modify these terms and conditions at any time without notice.

GOVERNING LAW

These terms and conditions are governed by the laws of the Province of Quebec. Any dispute shall be submitted to the jurisdiction of the courts of Quebec.
